SECTION 1 – SCOPE
The business relationships between NOURISHED3 GmbH and the buyer shall be subject exclusively to the version of the following General Terms and Conditions applicable at the time the order is placed. Conflicting terms of business or purchase of the buyer shall only be deemed recognized if this has been explicitly agreed upon in writing.
SECTION 2 – CONCLUSION OF CONTRACT
By sending an order via the website, the buyer makes a binding offer to NOURISHED3 to conclude a purchase agreement. If you place an order with NOURISHED3, we will email you confirming receipt of your order and the order details (confirmation of order). This confirmation does not constitute acceptance of your offer but merely informs you that we have received your order.
A purchase agreement is only concluded when we dispatch the product(s) and confirm shipment via a second email (shipping confirmation). No purchase contract is concluded for products that are not included in this shipping confirmation.
NOURISHED3 does not offer any products for purchase by minors. Products intended for children may only be purchased by adults. By placing an order, you confirm that you are of legal age. We accept no liability for orders placed by minors.
SECTION 3 – RIGHT TO CANCEL WITHIN 14 DAYS
You have the right to revoke your contractual declaration within 14 days without stating any reason, by notifying us in writing via email.
The cancellation period begins after you receive this cancellation notice in text form, but not before you receive the goods (or in the case of recurring deliveries, the first partial delivery), and not before we have fulfilled our legal obligations to inform you in accordance with Article 246 Section 2 in connection with Section 1 (1) and (2) of the Introductory Act to the German Civil Code (EGBGB), and Section 312g (1) Sentence 1 of the German Civil Code (BGB).
To cancel, you must notify us via email within this period. The deadline is considered met if the cancellation request is sent within the 14 days.
Important Exceptions:

Opened or used products cannot be canceled or refunded.

Orders that have already been shipped cannot be canceled. However, they may be returned once received, following the instructions outlined in our Returns Policy.

CONSEQUENCES OF CANCELLATION
If the cancellation is accepted and the goods are unopened and eligible for return, we will refund all payments received, including standard delivery charges (excluding any additional charges for express or non-standard shipping).
Refunds will be issued using the original payment method and processed within 14 days from the day we receive the returned goods or proof of return.
You are responsible for returning the goods to us at your own cost and risk, within 14 days of notifying us of the cancellation.
You are only liable for any loss in value of the goods if this loss in value is due to handling that was not necessary for checking the condition, quality, and functioning of the goods.

SECTION 4 – AGREEMENT ON RETURN DELIVERY COSTS
If you make use of your right to cancel, you will bear the standard return delivery costs.
SECTION 5 – OFFSETTING & RETENTION
The buyer may only offset claims that are legally established, undisputed, or recognized by NOURISHED3. The right of retention may only be exercised for claims arising from the same contractual relationship.
SECTION 6 – PRICE
All prices listed include applicable statutory VAT, unless explicitly stated otherwise.
SECTION 7 – RETENTION OF TITLE
Delivered goods remain the property of NOURISHED3 until full payment has been received.
SECTION 8 – APPLICABLE LAW
All contracts and deliveries are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
SECTION 9 – LEGAL VENUE
The legal venue for all disputes arising from the contractual relationship is Munich, Germany.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
SECTION 11 – SUBSCRIPTIONS
By subscribing to recurring product shipments, you agree that:

(a) NOURISHED3 (or its payment provider) is authorized to charge you at the interval you selected (e.g., every 30, 60, or 90 days) for your subscription, including taxes and fees;

(b) your subscription will continue until canceled.
You may skip shipments or cancel anytime. Cancellations must be made at least 30 days before the next billing date, visible on your account page.

Late cancellations will apply to the next cycle. You are responsible for all charges until the cancellation takes effect.
SECTION 12 – SMS PHONE NUMBER COLLECTION
By consenting to receive SMS marketing at checkout, you agree to receive recurring messages (including order updates, abandoned cart reminders, promotional offers, and review requests). Message frequency varies. Consent is not a condition of purchase.
To unsubscribe, reply STOP or use the unsubscribe link in any message.

We may change our short code or phone number at any time. Messages sent to outdated numbers may not be received.
We are not liable for failed, delayed, or misdirected messages or the actions you take based on them.

SECTION 14 – SHIPPING POLICY
We ship to Germany, the EU, the United States, and select international countries. Orders are typically processed within 1–3 business days.

We are not liable for indirect damages, loss of profit, or harm due to improper use of our products.
Under German law, consumers have a 2-year statutory warranty for goods. Please contact us immediately if your product is defective.
SECTION 18 – FORCE MAJEURE
We shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, war, natural disasters, epidemics, labor strikes, and transport disruptions.
